A patient’s Will remains valid until the patient changes the Will, revokes the Will, or makes a new Will. Any such change must also comply with the same requirements for signing.
A patient can change or update a Will whilst they have testamentary capacity, by:
- making a codicil – which is a separate document altering the Will; or
- making a new Will.
Where changes in a patient’s circumstances occurs, the patient should be advised to review their Will. Such changes include additions to and deaths in the family, relationship breakdowns, changes in property or assets, or changes to relevant legislation relating to wills and succession.
