A Will is a legal document that gives instructions on how the assets of a person are to be distributed after their death.

Where a patient dies without a valid Will (known as dying ‘intestate’), their estate will be divided according to a pre-determined formula set out in legislation. The formula, which varies in each state and territory, may not distribute a patient’s assets in the way they intended.

It is therefore important that patients be advised to have a clear, up to date and legally valid Will to ensure their assets will be distributed according to their wishes.
